Why would a single person need an estate plan?


Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys.  Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.

 

Why would a single person (without kids) need an estate plan?  Well, for a variety of reasons, including, but not limited to:

  • They don’t want who the state to decide who gets their stuff or to have their stuff.

    • In Minnesota, we look to Stat. §524.2-103 we would see that if they’re not married, nor have any children, their stuff would go to their parents, then their siblings. Maybe you want your money or assets or property to go to a different individual or charity.  That’s a reason to get an estate plan.



  • If you’re not married, you don’t have an “automatic” person doctors, financial people, or the state will turn to, to receive answers on your behalf.

    • If you’re in a relationship but not married to someone, you need an estate plan to appoint them as your “automatic” person.



  • Maybe you don’t need a Will, because you’re ok with your parents or siblings receiving your estate. BUT chances are you still need a Power of Attorney and Health Care Directive.

    • My firm does not “oversell” services to achieve a greater profit. If you don’t need a Will, I’m not going to sell you a Will.
