Why would a retiree with grandkids need an estate plan?Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys. Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.
In addition to the need for a Power of Attorney and Health Care Directive (especially if capacity is a concern for one or both spouses), grandparents sometimes wish to include specific gifts for their grandkids.
This is a great option for many people, especially if their children are already financially secure. It can be done in several ways (best discussed with an attorney depending on the amount of the gift and the age of the grandkids), but the important thing is it must be planned because a gift to the grandchildren will not happen without specific planning. Minnesota statutes do not automatically give to grandchildren.
