What is an Estate Plan?Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys. Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.
When you hear, “Estate Plan”? What comes to mind?
- “Oh, that’s something only rich people need.”
- “Oh, that’s something only parents need.”
- “Oh, that’s something other people need.”
Actually, it’s something everyone needs. An estate plan is a set of documents customized to what you need. It might be a Power of Attorney and Health Care Directive, and that’s it. It might also include a Will (with or without a Trust). It might include a real estate document. It might include other documents to handle out of state real estate, or a blended family, or retirement assets, or tax planning. It might be just for you, or you and a spouse.
But, I’m here to tell you that if you’re over 18, you need at least one, if not more of the above documents. Because estate plans are for everyone. They allow you to speak for yourself when you can’t otherwise speak for yourself. They take the ambiguity out of difficult times.
