What is the (Qualified) Domestic Relations Order?

A Qualified Domestic Relations Order (QDRO) or a Domestic Relations Order (DRO) is a complicated document drafted by an attorney, and signed and entered by the judge after your J&D has been entered. The QDRO or DRO divides retirement assets. An attorney can tell you if a QDRO or DRO is appropriate in your case depending on the type of retirement account that is being divided.
Parties may divide retirement as part of a property settlement, especially in cases where one party has the majority of the marital retirement in his or her name. This may also be used to “heavy load” one party in retirement assets as a waiver in spousal maintenance or to offset one party keeping the house.
