Coffee with Claire #23 – Commonly Asked Questions Blog Series

What is the Summary Real Estate Disposition Judgment?

Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys.  Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.

The Summary Real Estate Disposition Judgment (SREDJ) is a mini J&D.  It handles only the real estate in a dissolution action.  The purpose is when you record the SREDJ with the county property records to change/clear title of the real estate, you only have to record the SREDJ instead of the J&D.

This allows the parties more privacy so all of their marital information (including kid information) isn’t also recorded with property records.  Whenever the house is sold or the title is searched in the future, the parties need not worry their entire divorce will be brought up, only the SREDJ which states the property information, awards the property to one party, and then also lists any liens associated with the property.  It is a cleaner version of the J&D.

If you have questions about a divorce proceeding, please contact Claire Tralle to set up a free initial telephone call.
