Coffee with Claire #19 – Commonly Asked Questions Blog Series

What is the Affidavit for Proceeding In Forma Pauperis?
Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys. Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.
The Affidavit for Proceeding In Forma Pauperis or (IFP) is a confidential document that can waive your court fees upon approval by a Judge signing an Order for Proceeding In Forma Pauperis. The court forms can be found on the court website HERE.
The IFP waiver is not available to everyone. It is based upon income, family size, and whether or not you receive county services such as MA, SSI, SNAP, and others. You fill out the affidavit answering questions about income, family size, and county assistance, and a Judge either approves (meaning your fees will be waived or reduced) or denies (meaning you will be required to pay court fees) your affidavit.
