What is Child Support?Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys. Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.
If you’re paying child support, it almost always feels like it’s too much. If you’re receiving child support, the opposite is usually true. Child support is based upon the income of both parents, and then divided based upon parenting time, who pays medical/dental premiums, and child care.
Child support is quite straight forward if both parents are W2 employees. It’s based upon a calculation by Minnesota statute (see Minn. Stat. §518A), and can be calculated by anyone from the DHS website, HERE.
Many, but not all, people have a child support caseworker who should be your first line of contact. They have access to information that “regular” attorneys do not, and can often answer any question you may have. They are an excellent resource which should not be overlooked.
Child support is more complicated when a parent is unemployed, underemployed, or self-employed. If you are in one of those situations, the best advice is to speak with an attorney to see what you can do.
