How Long will Probate Take?Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys. Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.
The “average” probate usually takes somewhere between 6-18 months. In Minnesota, we have a creditor window period where people can file claims against the estate that lasts 4 months (see Minn. Stat. §524.3-801), so any open probate must last at least 4 months.
If real estate is involved, it usually takes longer simply because it usually takes some time for houses to sell.
The other factor that can dictate how long a probate lasts is how long it takes the Personal Representative to administer the estate. Most PRs have jobs/life outside of the probate, which means the probate can sometimes fall to the back burner.
The 6-18 month timeline does not include probates which are fought over. If friends, family, acquaintances are fighting in court over some part of the estate, then that timeline goes completely out the window.
