Do I need a Trust?Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys. Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.

The “quick” answer here is also you need to talk with an attorney. There are several things to consider as to whether a trust is appropriate for you. For some people it would be malpractice for me not to insist they have a trust. For others it really isn’t necessary; and for some others they fall somewhere in the middle.
Factors to consider when determining whether a trust is right for you include, but are not limited to:
- Whether you’re single or married;
- Whether you have children, and what their needs are;
- Whether you own real estate and where that real estate is located;
- Whether you have a taxable estate; and
- What your other assets are (i.e. life insurance, investments, retirement, ect…).
