Coffee with Claire #1 – Commonly Asked Questions Blog Series
January 3, 2018
Do I have to go to Probate?Writer’s note: This blog series is meant to act as responses to “quick” questions you may have for attorneys. Think of these answers as a “quick” answer you might receive over coffee from your friendly neighborhood attorney.
The “quick” answer to this question is, talk to an attorney. There are several variables that factor into whether probate is required after you or a loved one dies. To see more about the probate process and what the first step - talking with an attorney – looks like, click HERE. To learn about what you can do before you meet with an attorney, click HERE.
The several things an attorney needs to look at are: Was the deceased married? How are the assets titled? Jointly? In the deceased’s name alone? Is there real estate? How is that titled? Where is it located? What are the assets? What are the debts? Who will inherit? Whenever you have that many questions to answer a “quick” question, it no longer becomes a “quick” answer.
