Same-Sex Marriage in Minnesota

A few months ago - April 1, 2013 to be exact – I posted about how GLBTQ couples in Minnesota required different estate planning advice than their hetro-coupled counterparts. As of August 1, 2013 that will no longer be the case here in Minnesota (except for any couples choosing not to be married). On May 14, 2013 Minnesota became the 12th state in the country to allow same-sex marriage.I am posting about this now (as opposed to two weeks ago) because Hennepin County just announced that they are accepting marriage licenses starting June 6, so same-sex couples may actually get married on August 1, rather than waiting the 5-day period and marrying on August 6.
The Freedom to Marry Act will bring many changes not just for estate planning but for family law cases as well. In some ways this is a “new and exciting” time to practice in Minnesota, but in many ways the only things that will change is certain phrases.
Something to keep in mind: if you and your spouse were legally married in another state (say, Iowa) you cannot “remarry” in Minnesota. Rather, your marriage will be legally recognized in Minnesota beginning August 1, 2013.
